DMCA Reports
Inklawclothing respects copyright. If you own a work and believe material on this site infringes it, this page explains how to send a notice and how a counter-notice works.
1. Our commitment
We do not want infringing material in our catalog. Should any product, image or text on inklawclothing.com infringe a copyright that you own or represent, notify us as set out below. The Digital Millennium Copyright Act (DMCA) sets the notice-and-takedown procedure we follow, at 17 U.S.C. § 512.
2. Elements of a valid notice
Send the notice in writing, with every element listed here:
- Signature: signed by hand or electronically by the rights holder, or by someone with authority to act for them.
- The work: name the copyrighted work you believe we copied; for several works in one notice, a representative list will do.
- Where it is on our site: enough detail for us to find the material you object to; the full page URL works well.
- How to reach you: your name, a postal address, a phone number and an email address.
- Good faith: a statement of your good-faith view that the material is being used without permission from the copyright owner or its agent, and without any legal basis.
- Sworn accuracy: a statement that everything in the notice is correct and, under penalty of perjury, that the exclusive right at stake is yours or that you may act for its owner.
3. Where to send notices
Put “DMCA Notice” in the subject line and email it to Inklawclothing, Attn: Copyright Agent, at [email protected]. Our contact details are listed at the end of this page.
4. What happens next
Each complete notice is reviewed without delay. Where the material looks infringing, we remove it or block access to it and write back to confirm the action taken.
5. Counter-notice
If you believe material was removed or disabled because of a mistake or misidentification, you may send a counter-notice to the same email address. It must contain:
- Signature: yours, on paper or electronic.
- What was taken down: identify the removed or disabled material and the location where it appeared beforehand.
- A sworn statement: you state, under penalty of perjury, that in good faith you consider the takedown or disabling to be a mistake or a misidentification.
- Identity and consent: your name, address and phone number, with a statement accepting the jurisdiction of the federal district court covering the judicial district of your address (for addresses outside the United States, any judicial district where Inklawclothing can be found), plus your consent to be served with legal process by the original complainant or that party’s agent.
When we receive a valid counter-notice, we send a copy to the person who filed the original notice. Unless that person tells us they have filed a court action seeking to restrain the activity, we may restore the material between ten and fourteen business days after receiving the counter-notice, as Section 512(g) provides.
6. Repeat infringers
Where appropriate, we remove material from, and end our dealings with, any party found responsible for repeated infringement.
7. False claims
Section 512(f) exposes anyone who knowingly and materially misstates that material infringes, or that it was removed in error, to liability for the damages that result, attorneys’ fees and costs included. If you are unsure whether material infringes your rights, consider getting legal advice before you send a notice.
8. Trademark and other concerns
Concerns about trademarks or other rights that fall outside the DMCA can be sent to the same address with the same level of detail. We review those reports too.
